Terms of Use
Last updated: [DATE OF PUBLICATION]
These terms apply to your use of myaupairs.co.za (the "platform"), operated by[REGISTERED COMPANY NAME] ("we", "us"). By creating an account you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the platform.
1. What we do, and what we don't do
We are an introduction platform. We verify caregivers and display, on each profile, the checks that have been completed. Families then contact caregivers and make their own decisions.
- We are not an employer or a labour broker. The platform does not employ caregivers, and caregivers listed on it are not our employees, agents or contractors. This also applies when you buy a paid product from us.
- Families are responsible for hiring. The family decides whether to interview, hire or keep a caregiver, and agrees the pay, hours and duties directly with them.
- Any working arrangement is directly between the family and the caregiver. The family is the employer and is responsible for all employment obligations. These include a written contract, the Basic Conditions of Employment Act, the minimum wage for domestic workers, UIF registration and contributions, and COIDA where applicable.
- Verification shows what was checked on the date shown. It is not a guarantee of a caregiver's future conduct. Families should still interview caregivers, check references themselves and use their own judgement.
2. Who may use the platform
You must be at least 18 years old and able to enter into a binding agreement. You may only have one account and must keep your password private. You are responsible for everything done through your account.
3. Caregivers (nannies and au pairs)
- All information and documents you provide must be true, current and your own. Uploading false or altered documents will lead to permanent removal and may be reported to the authorities.
- You must have your referees' permission to share their contact details with us.
- You consent to us carrying out a background check (outside the platform), as described in our Privacy Policy.
- Your profile is only published once we approve it. We may decline, pause or remove a profile at our discretion, for example if information can't be verified.
- Badges are calculated automatically. If a check lapses (for example, your First Aid certificate expires), the badge is removed until the check is complete again.
- Listing is free.
4. Families
- Use caregivers' contact details only to discuss childcare work with them. Do not share them, sell them or use them for any other purpose.
- Treat caregivers with respect and comply with the law, including employment and anti-discrimination law.
5. Paid products for families
Creating a family account and contacting caregivers is free during our launch period. We'll give registered families plenty of notice before any paid plans are introduced. The products below are optional. Prices are in South African rand and are confirmed before you pay. OurRefund and Cancellation Policy explains your seven-day cooling-off right and when you can get a refund for each product.
- Concierge Match ([CONCIERGE MATCH PRICE]): we prepare a shortlist of caregivers based on your requirements. A shortlist is an introduction. We don't promise that a caregiver will be available or accept work, or that you will hire someone. Available on request. Contact us to book.
- Verify My Nanny ([VERIFY MY NANNY PRICE]): we arrange [WHICH CHECKS ARE INCLUDED] for a nanny you name. You must have the nanny's informed consent first, and we won't submit a check without it. A check shows what was found on its date and is not a guarantee of future conduct. Available on request. Contact us to book.
Buying a paid product doesn't make us the employer of any caregiver or change section 1 of these terms. You remain responsible for hiring and for all employment obligations.
6. Things you may not do
- Provide false information or impersonate anyone.
- Harass, threaten or discriminate against any user.
- Copy or collect profiles or contact details ("scraping"), or use the platform to send spam.

7. Suspension and closing your account
You may close your account at any time by contacting us. We may suspend or close an account that breaks these terms or puts other users at risk. Where reasonable, we will give you notice and our reasons.
8. Liability
We take care to carry out the checks shown on each profile accurately. To the extent permitted by law, including the Consumer Protection Act, we are not liable for the acts or omissions of families or caregivers, or for any loss arising from an arrangement between them. Nothing in these terms limits any right you have that cannot be limited by law.
9. Intellectual property
The platform's name, logo, badges, design and content belong to us. You keep ownership of what you upload, and you give us permission to display your profile content on the platform for as long as your profile is listed.
10. Changes
We may update these terms. If we make significant changes, we will tell you before they take effect. If you keep using the platform after that, you accept the new terms.
